b) AGREEMENT - Request approval and authorization for the Chair to sign Amendment #2 with the Aircon Energy, Inc. (Misc. Agm #2022-29 amended by Misc. Agm #2022-153) for the purpose of revising scope and covering increased material costs, thereby increasing the total amount to $7,501,045.45

Financial Impact:
Funds requested to be transferred in are from the loan for the project, and will not impact the General Fund budget.
Background Information:
As this Energy Conservation Project nears completion, staff is bringing back revisions to the contract that were necessary to address changes in conditions and additional improvements. The unforeseen conditions and costs were within anticipated ranges, and inclusion of additional energy saving measures within this contract, due to the energy savings over time, was deemed prudent. Typical change order authority is up to 10%, and this project stands at 3.6%.
