Financial Impact:
There is no financial impact to the General Fund. Miscellaneous Revenue received from civil penalties for environmental cases will be used to fund the expenses related to Aqua Terra Aeris Law Group.
Background Information:
The Tehama County District Attorney’s Office (TCDA) and Tehama County Environmental Health department have engaged the services of Aqua Terra Aeris Law Group (ATALG), who specialize in cases of environmental nature. TCDA is paying for the services of ATALG from our Professional Services budget and offsetting those expenditures with an Enforcement of Consumer Protections Miscellaneous Revenue account. Funds in this Miscellaneous Revenue account were collected from civil judgments and penalties stemming from environmental prosecutions occurring throughout the State, of which TCDA obtains a percentage. The use of funds from this Miscellaneous Revenue account, because of their source, are limited in their scope of use to instances such as this.
