Requested Action(s)

recommendation

a)                     Request approval and authorization to sign a side letter of agreement between Tehama County and the Tehama Count Peace Officers Association revising Article 11:  Wages and Classifications Section 4:  Working Out of Class Pay or Temporary Upgrade Pay, effective 7/30/24

body

Financial Impact:

The financial impact is dependent upon the number of employees assigned to work out-of-class.  Without knowing the number of times this will occur, the financial impact is unknown, but is anticipated to result in a minimal amount.

Background Information:

Tehama County and the Tehama County Peace Officers Association (TCPOA) have been meeting and conferring regarding a successor MOU.  During this process, a tentative agreement has been reached revising Article 11 Section 4 of the Memorandum of Understanding (MOU) between Tehama County and TCPOA.

Proposed changes are a result of legislation which codified GC §20480 several years ago.  Revisions include adding definitions for working-out-of-class and temporary upgrade pay which identifies when an employee will be identified as working-out-of-class and when an employee will be identified as working in temporary upgrade pay, and how both these situations will be reported to CalPERS.  In addition, the compensation for working-out-of-class was simplified to reflect no less than a 5% increase than the compensation rate the employee was receiving prior to the temporary assignment, but no more than Step 5.

Tehama County and TCPOA have met and conferred regarding the proposed changes and an agreement has been reached.  If the Board of Supervisors does not approve the proposed changes, the collective bargaining process will not be complete.
