a)                      AGREEMENT - Request approval and authorization for the Chairman to sign an Employment Agreement with Joseph Ulloa for the position of Chief Probation Officer, effective 12/18/23 through 12/17/24 or until a permanent Chief Probation Officer replacement is appointed

body

Financial Impact:

The proposed contract sets the annual salary at $138,809. The estimated cost with salary, benefits, and roll-up costs for the one-year contract is approximately $185,768.99. However, the Department intends to hold Mr. Ulloa’s current position of Deputy Chief Probation Officer vacant during the term of the contract resulting in an annual savings of approximately $175,546.72.

Background Information:

Joseph Ulloa has been working as the Interim Chief Probation Officer since June 30, 2023. According to Government Code 20480, working out of class assignments are limited to 960 hours per fiscal year. As of December 15, 2023, Mr. Ulloa has met the 960 hours maximum for the 2023/2024 Fiscal Year. Therefore, Mr. Ulloa has agreed to a one (1) year employment contract as the Chief Probation Officer for the County of Tehama or until a permanent Chief Probation Officer replacement is appointed.

A competitive recruitment is in process to find a permanent replacement. The Chief Administrator, the Presiding Judge of the Superior Court of California, County of Tehama and Mr. Ulloa have agreed to the salary, benefits, and all terms and conditions contained in the attached agreement.  Benefits contained within the employment agreement are standard in all department head contracts, which include $60 per month cell phone allowance, 9.23 hours per pay period of Personal Time Off (PTO), 40 hours of Management Time Off (MTO) per fiscal year, one (1) personal holiday per year, Parental Leave, Bereavement Leave and participation in the County sponsored Deferred Compensation plan on the same terms and conditions as employees in the Tehama County Management Employees' Association (TCMEA).

Additionally, the proposed agreement clarifies that Mr. Ulloa is considered a Classic Safety employee for purposes of the California Public Employee's Pension Reform Act of 2013.

If the Board does not approve the proposed employment agreement with Joseph Ulloa as the Chief Probation Officer, the County will be without a Chief Probation Officer.  This is a contract, overtime exempt position.
