There is no financial impact associated with the approval of this Resolution.

 

Background Information:

This Resolution is being brought forward as the result of a recommendation made by the 24/25 Grand Jury for Tehama County to clarify which Tehama County Personnel Rules apply to whom, and more specifically which personnel rules apply to elected officials.  The goal of this recommended distinction is to help eliminate ambiguity and provide a clearer and more uniform application of rules.  As a result, the Tehama County Personnel Office worked closely with the Personnel Procedures & Guidelines Ad Hoc Committee over the last several months to develop the attached Resolution and accompanying exhibits.  The Resolution and accompanying exhibits add clarifying language to the personnel rules.  Specifically, the clarifying language and exhibits more clearly identify which personnel rules apply to elected officials (appointed and elected) through categorization of personnel rules into three different classifications.  In addition, the Resolution adds clarifying language to more accurately reflect that "The provisions of the Tehama County Personnel rules shall not supersede any state law, federal law or current collective bargaining agreement between an employee organization and Tehama County.  Further, the provisions of the Tehama County Personnel Rules shall not preclude specific County departments from developing more restrictive operational policies and procedures." 

 

In addition to the Resolution and exhibits, there was a recommendation to make minor revisions to TCPR §1101:  Personnel Rules (General Provisions) and TCPR §1301:  Code of Conduct. 

 

TCPR §1101:  Personnel Rules (General Provisions):  This rule is being revised to provide clarity to the overview section.  Specifically, including language which identifies “officials (both elected and appointed),” and excludes certain individuals as explicitly identified within the rule, or if they are “disallowed by law.”  Additional changes include removing language reflecting a majority vote for Department Heads and adds “review, and comment within a timely manner.”  The title for the Chief Administrator was updated and reference to GC §82048 was added.  Further, the newly proposed language changes have been added as outlined in the aforementioned Resolution.

 

TCPR §1301:  Code of Conduct:  This rule is being revised to provide clarity to the Guidelines section, specifically the "Appropriate use of funds".  These changes were recommended by committee members because there was a general feeling that sometimes decisions have to be made which are not necessarily in the best interest of the County, however; those decisions are still in compliance with associated state and federal laws and County Policies and Procedures.  Further, the newly proposed language changes have been added as outlined in the aforementioned Resolution.

 

These Personnel Rules align with the negotiated agreements and ensure consistency across all bargaining units.  The Personnel Office has met the requirement to meet and confer with the bargaining unit representatives regarding these new personnel rules and agreements have been reached.
