Financial Impact:

A zero dollar approach avoids the administrative burden of contract amendments completed by counties and DHCS. The existing Mental Health Plan (MHP) contract is already zero dollar with no issues. All eligible county and provider claims will continue to be paid in accordance with the contract and applicable law. Matching funds to be paid using Realignment and Mental Health Services Act (MHSA). No impact to the General Fund.

 

 

Background Information:

The County is the designated contractor with the State Department of Health Care Services for the provision of various alcohol and drug services to County residents. The State and County enter into this contract for the purpose of identifying and providing covered services for substance use treatment in Tehama County pursuant to Sections 11848.5(a) and (b) of the Health and Safety Code (HSC), Sections 14124.20, 14021.51-14021.53, and 14124.20-14124.25 of the Welfare and Institutions Code (W&IC), and Title 22 of the California Code of Regulations, Sections 51341.1, 51490.1, and 51516.1.

 

It is important to note that this agreement does contain the State's standard indemnification language which requires Counties to defend the State in any adverse actions, irrespective of whether or not there is any negligence on the part of the County.
