Financial Impact:
This report discusses the funding the District has collected under their existing regulatory authority. In addition, staff is requesting Board direction that will affect District expenses.

Background Information:
The District's Rule 2:11D Indirect Source Rule provides for a report to be prepared every year. District staff published the attached Accountability Report on the District website and also notified Building and Planning departments within Tehama County.

Rule 2:11D is designed to reduce emissions from construction of new single family, multi-family dwellings, as well as commercial and industrial structures and similar indirect sources of emissions. The authority to regulate indirect sources of emissions is part of the California Clean Air Act of 1988. Health & Safety Code Section 40716, states that "a district may adopt and implement regulations to...reduce or mitigate emissions from indirect and areawide sources of air pollution."Healthy & Safety Code Section 42311, Subdivision (g) specifically allows districts to adopt a schedule of fees on areawide or indirect sources of which are regulated, but for which permits are not issued, to cover the costs of Districts programs related to this source.

Per the Rule, mitigated fees collected are separated into two (2) separate accounts. The designation of each account is specific to the pollutant to be mitigated.
