b) AGREEMENT- Request approval and authorization for the Sheriff to sign the Memorandum of Understanding (MOU) with Butte County Sheriff’s Office (BCSO) for the purpose of providing specialized forensic services in the amounts set forth in Exhibit A, with maximum compensation not to exceed $50,000.00 per year, effective 7/1/2026 and shall expire 6/30/2027

Financial Impact:
The outstanding invoices to be paid by Purchase Order for FY 25-26 and the Agreement have been budgeted for FY 26/27 in the Coroner’s Budget, 2072-53230.
Background Information:
The Sheriff’s Office is requesting approval to enter into a Memorandum of Understanding (MOU) with the Butte County Sheriff’s Office to provide specialized forensic services related to in-custody deaths occurring within Tehama County.
Assembly Bill 1108, the Forensic Accountability, Custodial Transparency, and Safety (FACTS) Act of 2025, establishes requirements for the independent forensic examination and investigation of in-custody deaths. The legislation requires a county in which the Sheriff and Coroner functions are combined to contract with one or more qualified counties or independent medical examination providers to perform the required forensic services when an in-custody death occurs. The purpose of this requirement is to ensure that forensic examinations and determinations regarding the circumstances, manner, and cause of death are conducted independently and objectively, thereby avoiding actual or perceived conflicts of interest.
Through the proposed MOU, the Butte County Sheriff’s Office, through its qualified forensic personnel, will provide the specialized forensic services necessary for Tehama County in the event of an in-custody ...
