Requested Action(s)

recommendation

a)                     Request authorization for the County Clerk to conduct and consolidate a Special Election with the 6/2/26 Statewide Direct Primary Election per Resolutions for Measures submitted by the following agencies as listed in the attachment

body

Financial Impact:

Prorated election costs will be reimbursed by the various Districts after the conduct of the election.

Background Information:

Pursuant to Elections Code section 10002, the governing body of any city or district may by Resolution request the Board of Supervisors of the County to permit the County Elections Official to render specified services to the District relating to the conduct of an election.

Additionally, pursuant to Elections Code Section 10400, whenever two or more elections, including bond elections, of any Legislative or Congressional District, Public District, City, County, or other political subdivision are called to be held on the same day, in the same territory, or in territory that is in part the same, they may be consolidated upon the order of the governing body or bodies or officer or officers calling the elections; and such election for Special Districts may be either completely or partially consolidated.

The Elections Department follows Municipal Election Law, Election Code sections 10100-10266; Uniform District Election Law, Election Code sections 10500-10556, and School District Governing Board Elections Law, Elections Code sections 10600-10604 and Education Code sections 5000-5442. The date for the election is set out in Election Code sections 1303 and 1304.

If the Board of Supervisors does not approve the consolidation, the elections could not be consolidated and conducted by the Elections Department and would cause an undue burden on the Districts.
