Background Information:

Pursuant to Title 22 CCR Section 67450.25(a)(3)(B) and Section 67450.4(b)(16), the operator of a household hazardous waste facility must enter into a written agreement allowing for the facility to operate with the property owner.

 

The attached agreement to allow the Agency to operate the Corning Household Hazardous Waste Facility on the property of USA Waste of California (WM/Corning Disposal) expired April 30, 2024, unless written notification consistent with the terms of the agreement is provided by either party. Agency staff and USA Waste of California negotiated an extension of the current agreement allowing Corning collection events to continue until October 31, 2024 to accommodate the RFP process, which WM had previously advised that it planned to submit a proposal for. The Agency had previously received an additional extension prior to that.

 

The Agency continued to be open to conversations regarding a successor agreement with WM, but requests for data supporting WM’s request for compensation for the Agency to site the facility at Corning Disposal have not been met. As such, despite numerous conversations, the Agency has yet to receive an agreement from WM. Absent an extension to the current agreement, collection events at Coirning Disposal will cease beginning November 1st, 2024 until both parties agree to a new agreement or the Agency relocates the facility. Agency staff have already began discussions with Lawrence and Associates regarding the facility’s relocation.

 

As the Board is aware, the Agency’s current household hazardous waste service provider is ACTenviro, which was recently purchased by Republic Services. Republic Services is a competitor of WM.
