Financial Impact:

There is no dollar amount associated with the agreement. This agreement sets forth conditions and requirements that the County must meet in order to receive funding from various State program sources. There is no impact on the General Fund.

 

Background Information:

The Department of Health Care Services (DHCS) administers the Mental Health Services Act (MHSA), Projects for Assistance in Transition from Homelessness (PATH), Substance Abuse Treatment and Prevention Block Grant (SABG), and Community Mental Health Services Grant programs and oversees the county provisions of community mental health services.  The County must meet certain conditions and requirements in order to receive funding from these various programs including Mental Health realignment.

 

The Board of Supervisors originally approved the County Performance Contract on 8/17/21 and approved Amendment No. 1 on 3/19/24. This Amendment No. 2 extends the contract end date by one year, and adds Sections 9 and 10 to the agreement’s Exhibit A. These additional sections cover the use & reporting terms for GenAI Technology and the Executive Order N-6-22 regarding Russia Sanctions.

 

It is important to note that this agreement for participation in the State's Performance program contains the State's standard indemnification language which requires Counties to defend the State in any adverse actions, irrespective of whether or not there is any negligence on the part of the County.
