Background Information:

In September of this year the Board passed resolution 8-2024 in light of the newly adopted GSP’s. The resolution was intended to comply with Executive order N-7-22 paragraph 9 modified by N-3-23 paragraph 4 giving GSA’s authority to act unilaterally in setting requirements for an approval letter for the installation of new agricultural wells. Also, in September of this year Governor Newsom issued executive order N-3-24. Paragraph 6 of the order modified the previous orders and removed the authority of the GSA to act unilaterally in regard to well permit issuance. Because of this modification, Environmental Health is not required to request approval from the GSA for new installations and is no longer required to determine if an installation will interfere with existing wells or cause subsidence. This action makes the requirement and intent of the resolution moot. The GSA does still have the authority to request Environmental Health to add conditions to the issuance of permits or restrict installations in specific areas via regulation such as the existing screening and sealing depths. The Board of Supervisors with recommendations from EH staff could resolve to allow this cooperation.
