Requested Action(s)

recommendation

a) RESOLUTION: Request adoption of the resolution authorizing the Sheriff’s Office to retain the Law Firm of Jones Mayer to provide conflict legal counsel and advisory services in connection with an ongoing criminal investigation involving public officials and county department heads, agreement will not exceed $100,000.00

body

Financial Impact:

Funds to come from the General Fund FY 25/26, pursuant to Government Code Section 31000.6.

Background Information:

The Tehama County Sheriff's Office is actively engaged in a criminal investigation involving allegations of misconduct by current and/or former county public officials and department heads. Due to the nature of the investigation and the potential involvement or association of County Counsel and the Tehama County District Attorney’s Office with those under investigation, significant conflicts of interest have been identified that preclude reliance on those offices for legal counsel and prosecutorial guidance.

The Sheriff's Office seeks to retain Jones Mayer, a legal firm with extensive experience representing California Sheriff’s Offices. The firm has:

-                     Former District Attorney’s on staff to assist with the criminal legal review of investigative findings

-                     California Public Records Acts (CPRA) experts to guide lawful release of case-related records and reports

-                     A history of providing legal counsel tailored to the unique needs and responsibilities of law enforcement

This request is made under the authority of California Government Code § 31000.6, which permits the Board of Supervisors to contract with private legal counsel, when it is determined that county counsel is unable to represent the requesting officer due to a conflict. Once a contract is negotiated, it will be returned for approval by the Board.
