a) AGREEMENT - Request approval for the Clerk & Recorder to sign the Addendum for FY 26-27 to the Memorandum of Understanding with the Department of Justice (DOJ) (Misc. Agree. #185-2013) for regulation and oversight of the Electronic Recording Delivery System (ERDS) Program in the amount of $712.73, thereby extending the date through 6/30/27
body
Financial Impact:
The amount of $712.73 is included in the FY 2026-27 Adopted Budget and funds are collected and budgeted through the Electronic Recording trust fund.
Background Information:
The Board approved the Original Memorandum of Understanding on September 17, 2013 to participate in the Electronic Recording Delivery System (ERDS) Program. The ERDS Program allows the department to record documents electronically without having the customer come to the counter. The document is received via a secure web portal and, once it is recorded, it is sent back to the requesting agency through this same secure web portal. The department is currently recording 51% of it's documents through this method.
This addendum to the MOU will extend the term for the FY 2026-27, and will allow the county to continue to participate in the ERDS Program by paying a proportionate cost split between 52 counties based on their annual amount of electronic recordings. The amount can fluctuate based on the number of counties participating and the amount of electronic recordings that we have annually.
The State issues an MOU addendum each year that needs to be approved to continue Tehama County’s participation in the ERDS system. Each addendum acts as a separate agreement applicable only for the costs for that fiscal year in conjunction with all provisions provided in the original agreement (Misc. Agree #185-2013).
