Agree. 2025-89, to settle outstanding invoices totaling $10,000 related to the expired Misc. Agree. 2018-65, maintaining an amount not to exceed $100,000, effective 3/1/25 through 2/29/28

Financial Impact:
The funding source for the agreement has been budgeted for FY 25/26 in the Coroner’s budget, 2072-53230.
Background Information:
The County has been using Bennet Omalu Pathology Services since 2018 and prior to that when he was with Forensic Pathology Group to perform external examinations of decedents, external/internal investigations of decedents if deemed necessary by the Coroner, and to review medical or dental records of decedents.
When the previous agreement ended on February 28, 2025 (Misc. Agree. 2018-65), the total invoices received in March for the services rendered in February exceeded the total yearly agreement by $10,000. Amendment No.1 (Misc. Agree. 2025-089) included payment for the services rendered to resolve any claims and disputes existing prior to March 4, 2025. There was one invoice that was incurred in February but was not received until after Amendment No. 1 (Misc. Agree. 2025-089) was approved by the Board of Supervisors. The vendor assumed the final outstanding invoice had been received with the batch of invoices originally issued back in March and did not realize it had not been received until payment was received from the County. Amendment No. 2 is to issue payment for the final invoice outstanding from the previous expired agreement (Misc. Agree. 2018-65). The vendor confirmed no further invoices are outstanding.
